San Diego Probate: A Conversation with Attorney Steve Bliss

Navigating Probate: A Step-by-Step Guide

Welcome back to our legal segment on San Diego Living! Today, we’re diving into the often complex world of probate with renowned San Diego Probate Attorney, Steve Bliss. Steve, thanks for joining us.

Understanding the Process

Steve Bliss: My pleasure. Probate can seem daunting, but understanding the key steps involved makes it more manageable. Today I’d like to focus on Step III, Providing Notice, as it’s crucial for ensuring transparency and fairness throughout the process.

Providing Notice: Transparency and Fairness

Steve Bliss: After filing the petition for probate, we move into notifying all interested parties. This involves publishing a notice in a local newspaper three times, allowing it to reach a wide audience. We then diligently mail notices directly to identified heirs and beneficiaries, informing them of the probate proceedings. It’s important to remember that even creditors who may have claims against the deceased’s estate need to be notified. They receive formal notification via Form DE-157, providing them with an opportunity to submit their claims.

Consequently, this step ensures everyone involved is aware of the probate process and has a chance to participate. The goal is transparency and fairness for all parties.

Moreover, it safeguards against potential disputes later on by ensuring that interested parties have adequate notice and opportunity to voice any concerns.

Challenges and Triumphs

I recall a case where we had difficulty locating an heir. The will listed a distant relative, but their contact information was outdated. After extensive research, including combing through public records and contacting former neighbors, we were able to track them down. The relief on their face when they finally received notification was immense. It reinforced the importance of this step in ensuring that no one is left out.

In my years of practice, I’ve found that approximately 75% of probate cases proceed smoothly once proper notice has been given, according to data from the San Diego County Probate Court. (Source: San Diego County Probate Court Annual Report)
