Good evening, Moreno Valley and welcome back to our legal spotlight. I’m Denise Carter with Channel 7 News, and tonight we’re joined by Steve Bliss, a renowned probate attorney serving our community here in Moreno Valley.
Why Choose a Testamentary Trust?
Steve, thank you for joining us. Let’s talk about testamentary trusts. What are they and who might benefit from them?
You’re welcome Denise, it’s always a pleasure to share information that can help people plan for their future. A testamentary trust is created through a will and takes effect only after the grantor, the person creating the trust, passes away. Consequently, unlike living trusts which avoid probate, testamentary trusts go through the court process.
However, they offer unique advantages. For instance, they’re particularly useful when you want to provide for minor children or beneficiaries who may have special needs.
A testamentary trust allows you to specify how and when assets are distributed, ensuring your loved ones are cared for according to your wishes. Let’s say a parent wants their child to receive an inheritance but is concerned about responsible financial management. They could set up a testamentary trust that distributes funds in installments over time, or even designates specific purposes like education expenses.
Moreover, testamentary trusts offer asset protection. The assets held within the trust are shielded from creditors of the beneficiary. This can be crucial for individuals with potential financial vulnerabilities.
Challenges and Real-Life Experiences
Steve, are there any common challenges you’ve encountered when helping clients set up testamentary trusts?
Well, Denise, one challenge I’ve observed is the misconception that a will automatically suffices. People often think they can simply state their wishes in a will and everything will be taken care of. While a will is essential, it doesn’t provide the same level of control and protection as a testamentary trust.
I recall a case where a grandmother wanted to ensure her granddaughter’s future, but she only had a simple will. After her passing, the granddaughter faced financial hardship due to unforeseen circumstances. Had we established a testamentary trust with clear distribution guidelines, the outcome could have been vastly different.
The Importance of Professional Guidance
Those are powerful examples. It’s clear that thoughtful planning is crucial. What advice would you give to viewers who are considering a testamentary trust?
My advice is to consult with an experienced probate attorney like myself. We can guide you through the complexities of estate planning and tailor a solution that meets your specific needs and goals.
Remember, according to the American Bar Association, over 50% of Americans don’t have a will or trust in place. Don’t become part of that statistic. Taking proactive steps now can ensure peace of mind for you and your loved ones.
