“While testamentary trusts offer numerous benefits,” Mr. Bliss acknowledges, “they do have some drawbacks. Because they go through probate, the process can be time-consuming and more expensive compared to living trusts.”

The family had opted for a testamentary trust but hadn’t updated their will in several years. “This led to some confusion regarding asset distribution,” Mr. Bliss recounts. “Fortunately, we were able to work with the court and resolve the issues, ensuring the children received the care and support they needed.”
