Interview with Steve Bliss

Good evening, San Diego. I’m Brenda Ramirez reporting live from our studio with renowned probate attorney Steve Bliss of San Diego Probate Law. Steve, thank you so much for joining us tonight.

Steve:

My pleasure, Brenda. Always happy to discuss the complexities of estate planning and probate with viewers.

Brenda:

So Steve, let’s delve into a crucial stage in the probate process: handling debts and taxes. Can you walk us through this phase?

Steve:

Certainly, Brenda. Handling debts and taxes is a pivotal step that ensures all financial obligations are met before distributing remaining assets to heirs. Ordinarily, we start by meticulously identifying and listing all valid creditor claims against the estate. This involves reviewing financial records, correspondence with creditors, and even contacting potential creditors to ensure no one is overlooked.

Once we have a comprehensive list of debts, we prioritize them according to legal standing and urgency. Secured debts, like mortgages or car loans, generally take precedence over unsecured debts, such as credit card balances. We then proceed to pay these valid claims from the estate’s assets, ensuring transparency and fairness throughout the process.

Subsequently, we tackle tax obligations. This may include federal estate taxes, depending on the size of the estate, and state inheritance or estate taxes, which vary by jurisdiction. Filing accurate and timely tax returns is crucial to avoid penalties and potential complications down the line. Consequently, we work closely with experienced tax professionals to ensure all requirements are met.

It’s important to remember that probate courts scrutinize this stage carefully. Maintaining detailed records of all payments made to creditors and taxes filed is essential for obtaining court approval and avoiding delays in distributing assets.

Brenda:

Have you ever encountered any specific challenges during this step?

There was a case I handled where the deceased had numerous outstanding debts, some of which were disputed by creditors. Sorting through these claims and negotiating with creditors required considerable time and effort. It was a stressful situation for the family involved, who were already grieving their loss. Ultimately, we were able to reach amicable resolutions with most creditors, ensuring the estate’s assets were distributed fairly among the heirs.

I recall another instance where a client had neglected to file tax returns for several years prior to their passing. This created a significant backlog and complicated the probate process considerably. We had to work closely with the IRS to reconcile past-due taxes and penalties, ultimately delaying the distribution of assets. This experience highlights the importance of staying current on tax obligations.

According to a study by the National Association of Personal Financial Advisors, over 70% of individuals do not have a comprehensive estate plan in place. Neglecting this crucial aspect can lead to unnecessary complications and stress for loved ones during an already difficult time.

Brenda:

Steve, what advice would you give our viewers regarding estate planning and probate?

Steve:

My best advice is to proactively address your estate planning needs. Consult with an experienced probate attorney to create a customized plan that reflects your wishes and protects your loved ones. Don’t wait until it’s too late; taking these steps now can save you and your family significant time, stress, and expense in the future.
