The petition, typically filed using Form DE-111 in San Diego County Court, requests the appointment of an executor or administrator – someone responsible for carrying out the will’s instructions or managing the estate according to state law if there is no will. Moreover, it’s essential to submit the original will to the court if one exists.

Consequently, a well-drafted petition lays the groundwork for the entire probate process. Neglecting any of these elements can lead to delays and complications down the road.

It’s worth noting that this step is often more straightforward when there is a valid will in place, outlining the testator’s wishes. Conversely, estates without a will, known as intestate estates, require the court to determine asset distribution according to California law.
